Terms and Conditions Placing an order through DC Fontana constitutes acceptance of our terms and conditions of trade. As with any contract all parties should ensure that they have viewed and understood the full terms and conditions of the transaction. 
 

USER AGREEMENT

• Users over 18 agree to be bound by this contract.
• Users under 18 must have the permission of a parent or guardian or be supervised by a parent or guardian who agrees to this contract and the minor's use.
• The user agrees to be truthful in information disclosed on the site and agrees to what he or she is buying and to pay for it.
• Fraud attempts will be reported to the authorities.
• The user agrees not to copy materials on the site, not to reverse engineer or break into the site, and not to use the website materials, products or services to violate any law.
• The user agrees to use the site as per the instructions, not to disclose any password to others for use, and that the site has a license for use of anything the user submits or posts to the site.
• That the use of the site is at the discretion of DC Fontana and that any use by anyone may be terminated by DC Fontana at any time.

 
MINIMUM ORDER VALUE
We reserve the right to only supply orders to the value of 5.00 GBP total minimum, including postage, unless by prior arrangement.

PRICES
The price shown at the time of ordering is the price you pay. All prices quoted at our web site are in British Pound Sterling. Postage/shipping costs are extra and will be charged at the applicable and stated/advised rate. We reserve the right to change prices listed without notice. If a pricing error is made we retain the right to charge the correct price but we will always inform you of any changes before going ahead with your order.

PRODUCT INFORMATION
Every effort has been made to ensure information and images we provide are correct. We have taken every care to try and represent the goods accurately but images and colours may vary. The information should only be taken as a guide. All products and services are subject to availability and may be withdrawn at any time. This does not affect your statutory rights under UK law.

POSTAGE/SHIPPING
Postage charge includes packaging and handling overheads. We cannot be held responsible or liable for late delivery due to Postal delays that may occur due to busy periods of the year, industrial action, adverse weather, etc. Please see our complete list of postage/shipping terms listed in our Postage and Packaging Rates.

AVAILABILITY
Items are reserved on a first come first served basis and are subject to availability. Items are advertised in more than one location therefore availability may be out of date. Availability information may be subject to change without notification.

DELIVERY
Orders cleared for despatch are posted on Monday, Wednesday or Friday i.e. the closest delivery day. Items are despatched subject to a single parcel limit of normally up to 39.00 UKP.
In the event of a delay due to unforeseen circumstances, you will be advised via email accordingly. All goods are despatched by first class Royal Mail as standard. Overseas orders are sent by AIRMAIL. We normally only supply to the cardholders address unless by prior arrangement and agreement following further checks. We will not be liable for claims and damages in respect of late deliveries. Delivery estimates after despatch are normally :

• UK - next day to 3 working days
• Western Europe - 4 to 7 working days
• All other countries - 7 to 12 working days

If your goods take longer than this please check the address you forwarded to us before contacting us to check that we have used the correct address. If your order is damaged/not intact when it arrives, please contact your local Post Office to make a claim.  If any items you receive are not the correct items you ordered, please contact us and we will arrange an exchange or issue a refund. If items are lost in the post we will issue a replacement if available, providing checks have been made regarding the postal address furnished and any delay at your local Post Office. Any refusal by the issuer of any payment card to authorise the payment to us, for any reason, will not render DC Fontana liable for any delay or non-delivery. We do not have external order tracking facilities unless special delivery and insurance arrangements are made. Our contract with you is deemed to have commenced once your order is despatched.

PRIVACY
We are committed to protecting your privacy. We will only use the information that we collect about you lawfully. The type of information we may hold about you includes:

• your name
• address
• phone number
• email address

Personal data is collected on the order form and from e-mails or phone calls you make to us in providing order information. We will only collect personal information relevant to process the order. Your personal details will not be passed on to any third party other than to process your inquiry. Information supplied here remains strictly confidential. Your e-mail address will not be added to any third party mailing lists. But from time to time we may send you information regarding DC Fontana or DC Tone unless you indicate otherwise We value your right to privacy as much as we value your custom. We are the sole owners of any information that is collected using this site. We do not distribute or sell any of the information that is gathered. Addresses submitted to us will be treated in complete confidence. The information will not be used for any purpose other than that implicitly intended.

SECURITY
All communication between the client’s browser whilst processing an order form uses SSL security ( secure socket layer ). A lock icon must appear at the foot of the screen.

PAYMENT METHODS
Payment for orders made at our website must be made prior to despatch.

• By Email - Email your order details to us at: shop@dcfontana.com Ensure that you include all your contact details so we can get back in touch with you.
• By Telephone - Ring us on: +44(0) 182 7709804. Please leave a number for us to return your call if necessary.
• By Crossed Cheque Please mail your order and remittance made payable to DC Tone to us at: 5 Leedham Avenue, Bolehall, Tamworth, Staffs, B77 3LT, England
• Please include a daytime telephone number we can contact you on. Please quote your order reference number if applicable.
• Cash - No Cash payments are accepted of any type.

PAYPAL PAYMENTS
You do not need a PAYPAL account in order to make a payment through PAYPAL. Payment is not requested until goods are confirmed available for despatch. We will send you an invoice and you will be able to supply payment details directly to PAYPAL - we will not have access to this information. Orders from outside the UK will be converted and charged in your own currency wherever possible.

HOW TO ORDER

1. Select item(s) by clicking the "buy" button once to add to your basket ( look for a pop up window of your basket ) else save the line details to paste to the order form via the order button at top of page.( NB. Repeated clicking may increase the order quantity! ).
2. To amend/check the contents of your basket at any time click on the basket icon at top of page.
3. Select the relevant order method when you are ready to forward your details to us ( from basket pop up window or button at top of page if pasting ).
4. You must provide your order details if not automatically included together with full contact details and payment method.
5. Please include a space in the correct position for postal codes - delays will occur if omitted.
6. Email address must be valid - you will not receive an acknowledgement copy of the order via email if invalid.
7. If you have supplied a valid email address you will receive an acknowledgement copy of the order.
8. Check the order form for completeness and accuracy before printing a copy, if necessary, for your records or to submit/forward to us.
9. Note the order / returns reference number on the Confirmation page screen for future reference regarding the order.
10. Orders made by telephone, or post will be allocated a reference number which will be made available to you.
11. Any automated reply that you receive from us shall not be deemed as our acceptance of your offer to purchase goods.
12. We will only accept your offer and, therefore, a contract shall only be made once we process your remittance,despatch the goods to you, and confirm this by e-mail where possible.
13. If you forward an order pertaining to an existing order please advise us of the original order reference number and the reason for the additional submission.

TROUBLESHOOTING
If you experience any problems at the site please contact us. Here are a few tips to help your transaction processing.

• Post/Shipping - Make sure that you always provide your correct and current address, postcode/zip.
• E mail - Make sure that the email address you provide is correct.
• Addresses - Where the postal/shipping address is different to the billing address, the customer will be asked to provide extra proof of identity.

CUSTOMER SUPPORT

Telephone enquires can be made on +44(0) 182 7709804. Please leave a contact number if leaving a message. Please also include your order reference number if query pertains to an existing order. If you have any suggestions or comments to make please use the order form or email us above. Alternatively you can write to us at the above address - please note that at statutory holiday times we post news of any unusual closures at our site.

COMPLAINTS
In the event of a complaint, you can contact us by email on  shop@dcfontana.com Your complaint will be acknowledged within 2 working days and we will attempt to resolve it within 10 working days. All issues will be resolved within a month of the complaint.  The customer will be informed at every stage of the complaints process. Nothing mentioned in these terms and conditions affect your statutory rights as a consumer.

ORDER REFUSAL
We reserve the right to refuse any order.  We provide a list of acceptable destination countries in the Order Form. If your country does not appear, please contact us. Orders may be subject to further checks following authorisation. We retain the right to cancel items from your order if they are no longer available. We reserve the right to withdraw any items from sale, at any time prior to despatch, for whatever reason. You will be informed promptly if this happens. The order is to be deemed accepted when we process your remittance.

CANCELLATION
You may cancel all or part of your order at any time, including up to seven working days from the date the goods are received. Return of goods will be at your own expense. Please read the notes on returns below. Under UK trading laws we have 28 days in which to supply an order and any cancellation before this period is discretionary. We will refund your payment within 30 days from receipt of the returned goods.

RETURNS
Any non sale item can be returned unused for either a refund or exchange as you have the right to a cooling off period of 7 working days after the day of receipt of the goods. Goods must be returned in the original condition, securely packaged with labels intact, and not worn/used.  Please note that postage stamps must be attached to paper first before affixing to our waterproof packaging. The goods must be undamaged and not soiled for a refund to be given. Please quote the returns reference number you have obtained from us having advised us via email or telephone that you intend to make a return.  If this is not possible, make sure that you include the order reference number together with your name, address and a telephone number inside the package and please do not forget to tell us if you want a replacement or a refund. Returns received without the correct details may be subject to delay. If goods are deemed to have a manufacturing fault, please return to us within 7 days of receipt following notification to us. Please remember to include identifying documentation with any returned product. For faulty items or items sent in error, DC Fontana will refund the postage. For non-faulty/unwanted items return postage will be the responsibility of the customer.  This does not affect your statutory rights as a consumer.  You will be responsible for any returned goods until they reach us so we recommend you obtain evidence of postage e.g. proof of postage from the Post Office when returning goods in the UK. Refund of card payment can only be refunded back onto the original card used to purchase the goods.

SALE RETURNS
Customers should note that those goods shown as Special may only be returned for exchange or credit note but not for refund. This does not affect your statutory rights. Refunds or exchanges are not available for normal sale items. For these goods we can only offer a refund or exchange for faulty goods or if we make an error in processing you order. Refunds will be given within 30 days of agreement. Your statutory rights are not affected under UK law. International orders will be refunded at the rate of exchange when returned goods have been received.

We have links to other websites. We have no control and are not responsible for the privacy policies of these sites. If you are in any doubt, please check the privacy policies of the sites you are visiting as a result of a link from this site. Some of the links used on this site may use cookies, i.e. advertisers, but we have no control over the information that is gathered using cookies from their sites. Please note that any sites you access from links on this site are not in any way controlled by us, therefore we cannot be held responsible for any  of the material found at these sites.

Email messages leaving this site are subject to virus scans. However, you should carry out your own checks and we cannot accept liability for any loss or damage which may be caused by computer viruses. If you do not receive a confirmation email from us then please check the email supplied to us. NB. Email messages from HOTMAIL and some other mail accounts may only arrive if our address is in your address book.

DISCLAIMER
Whilst every care has been taken in the preparation of this site, the information contained herein may contain inaccuracies or typographical errors and DC Fontana’s liability for any inaccuracies or errors arising is excluded to the fullest extent permitted by law. If part of these terms is found to be unlawful, it shall not affect the validity of the remainder. As the contract for the sale of goods and services from the website is a consumer contract, DC Fontana will not be liable for any business loss that the purchaser may suffer. DC Fontana will only be liable for losses that can reasonably be foreseen. These conditions shall be governed and construed in accordance with the laws of England and all disputes arising in connection therewith
shall be submitted to the jurisdiction of the courts of England and Wales. This does not affect your statutory rights as a consumer.

WARRANTIES
To the fullest extent as permitted at law, DC Fontana is providing this website and its contents on an 'as is' basis and makes no representations or warranties of any kind, express or implied, with respect to this website or the information, contents, materials or goods included in this website including, but without limitation, warranties of merchantability and fitness for a particular purpose. DC Fontana does not represent or warrant that the information accessible via this website is current, accurate or whole.

ERRORS/OMISSIONS
The site is reviewed regularly and we will promptly correct any errors brought to our attention. You will help us to help you by advising us of any error  that you may note whilst using this site. If you find an error, please contact us.

 DEFINITIONS

• 'We','Us', 'Our' means the seller trading online.

• "Proof of Posting" means a certificate issued by UK Post Offices which confirms that package(s) were sent to the person at an address stated on the certificate, but which is limited in offering compensation for loss.
